ESOS Phase 4 Compliance & Reporting
Bureau Veritas provides comprehensive ESOS compliance support for UK organisations. From Lead Assessor-led energy audits and action plan reporting to full Phase 4 delivery, we are already helping organisations meet their obligations, avoid costly penalties, and unlock real energy savings.
Alongside compliance, ESOS also presents a valuable opportunity to:
• Reduce energy costs across operations
• Identify quick-win efficiency savings
• Support your Net Zero and decarbonisation strategy
• Strengthen ESG reporting and stakeholder confidence
What Is ESOS and Why Does It Matter?
ESOS (Energy Savings Opportunity Scheme) is the UK government's mandatory energy audit programme for large organisations. Established under the EU Energy Efficiency Directive 2012/27/EU and brought into force in July 2014, the scheme requires qualifying businesses to assess their energy use, identify opportunities for savings, and develop action plans to reduce consumption.
Compliance with ESOS is non-negotiable for large organisations. Failure to comply can result in significant financial penalties, and non-compliant organisations can be named on publicly available government websites.
Complying with ESOS provides a significant opportunity as comprehensive ESOS energy assessments typically reveal 10–30% savings potential through efficiency improvements. This means compliance can deliver a measurable return on investment alongside regulatory peace of mind. For wider environmental legal compliance support, see our Environmental Legal Compliance service.
Do You Qualify For ESOS?
You must take part in ESOS if your organisation, or any UK undertakings in your organisation’s group, qualifies as a large undertaking on the qualification date.
A large undertaking is any UK undertaking that meets one or both of the following conditions:
1. employs 250 or more people
2. has an annual turnover in excess of £44 million and an annual balance sheet total in excess of £38 million
The qualification criteria can be complex, particularly for group structures and organisations that have recently grown or restructured. Bureau Veritas can provide expert support in assessing your obligations under the ESOS regulations and support throughout the process.
If your organisational status on 31st December 2026 meets the ESOS qualification criteria, your deadline for Phase 4 compliance notification to the Scheme Administrator will be 5th December 2027. Early ESOS action will allow you to achieve compliance more cost-effectively and can deliver additional benefits for your business. Organisations that implement early are better placed to identify savings opportunities, manage resource requirements, and adapt to evolving regulatory requirements. We are actively delivering Phase 4 for clients now.
What’s New in ESOS Phase 4?
Phase 4 is a material shift, not a repeat of Phase 3. ESOS has moved from a periodic four-yearly exercise to an ongoing compliance and energy management programme. Here is what has changed:
-
Changes in compliance routes
Display Energy Certificates (DECs) and Green Deal Assessments (GDAs) have been removed as valid compliance routes. Organisations that have previously relied on these must identify and plan for alternative approaches
-
Annual Reporting
Since 2024, organisations must report progress against their ESOS action plan every year, not just at the four-yearly deadline. This includes explaining any actions that have not been achieved and providing justification for delays. Non-compliance risk now applies year-round, and organisations that are not actively managing their action plans face ongoing exposure.
Organisations subject to ESOS may also have obligations under Streamlined Energy and Carbon Reporting (SECR). Get in contact with our team to find out more.
-
Action Plan Disclosure
Action plans must now formally document planned actions and clearly indicate which are complete, in progress, or delayed. Justification must be provided for anything not achieved. This is a significant step up from Phase 3, where action plans were often high-level and rarely scrutinised.
-
Enforcement
Regulators are placing greater emphasis on data quality, board-level sign-off, and evidence that ESOS is being taken seriously as a business process. Expect closer scrutiny of evidence packs and reporting methodology.
-
Net Zero Integration
Phase 4 reinforces the expectation that ESOS compliance connects to your broader decarbonisation strategy. ESOS is shifting from a standalone audit to a component of continuous energy management, with senior-level visibility and clear links to net zero objectives.
-
Phase 4 Deadlines
If your organisational status on 31st December 2026 meets the ESOS qualification criteria, your deadline for compliance notification to the Scheme Administrator is 5th December 2027. Annual action plan reporting obligations for phase 3 apply now, regardless of this deadline.
Typical Outcomes We See
Bureau Veritas ESOS assessments consistently deliver measurable value beyond compliance. Across our client base, we typically see:
• Energy saving opportunities: Typically in the range of 5-20%, depending on the organisation’s size, complexity and existing energy management maturity
• Real financial impact: Over £21m in potential cost savings identified across Phase 2 & 3 delivery
• Clear investment prioritisation: We help organisations focus on the initiatives that deliver the strongest return, fastest payback, and greatest carbon impact
• Practical payback periods: Many low-cost operational improvements deliver returns in under 3 years, with larger projects aligned to longer-term investment plans
Specific outcomes vary by organisation, sector, and estate. Bureau Veritas will provide a tailored assessment of your savings potential as part of the engagement.
Annual ESOS Reporting
A significant change introduced in 2024 means that ESOS compliance activities are no longer restricted to the four-yearly deadline. Organisations are now required to report progress against their ESOS action plan every year, including explaining any actions that have not been achieved.
This increase in reporting frequency creates a higher level of ongoing risk for businesses that are not actively managing their ESOS action plans. Greater resources, time, and effort are required to meet these annual reporting obligations, and the consequences of non-compliance apply year-round, not just at the four-year deadline. Organisations subject to ESOS may also have obligations under Streamlined Energy and Carbon Reporting, get in contact with our team today to find out more.
Bureau Veritas can support you with annual ESOS action plan updates to ensure continuous compliance and reduce the administrative burden on your team.

FAQs
-
Who has to comply with ESOS?
ESOS applies to all large UK organisations outside the public sector. Your organisation must comply if, on the qualification date, it meets any one of the following criteria: 250 or more employees; annual turnover exceeding £44 million; or an annual balance sheet total in excess of £38 million. The qualification criteria can be complex for group structures or organisations that have recently grown, so it is worth seeking expert guidance if you are unsure of your status.
-
What are the ESOS Phase 4 deadlines?
ESOS is currently in Phase 4. If your organisational status on 31st December 2026 meets the ESOS qualification criteria, your deadline for compliance notification to the Scheme Administrator is 5th December 2027.
-
What happens if I don't comply with ESOS?
Failure to comply with the ESOS regulations can result in significant financial penalties. Non-compliant organisations can also be named on publicly available government websites, creating potential reputational risk alongside the financial consequences.
-
Can ISO 50001 certification count towards ESOS compliance?
Yes. Organisations that hold a current ISO 50001 Energy Management System certification can use this as their compliance route under ESOS, rather than completing a separate energy audit. Bureau Veritas provides both ESOS compliance support and ISO 50001 certification services, meaning we can help you assess which route is most appropriate for your organisation and support you through whichever path you choose.
