Why you can't afford to ignore DSEAR

DSEAR

Many workplaces will handle, store or process dangerous substances. From food manufacturing to distribution, and many other sectors in between, workplaces could be handling dangerous substances, gases, vapours or dusts. And in all of these cases, the employer has a duty to control and reduce the associated risks Under the Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR).

Unfortunately, too many organisations are unaware of the risks until it is too late. The Health & Safety Executive (HSE) has issued a number of fines in recent years for breaches of DSEAR. Worse still, organisations could be putting their workers at risk by not maintaining safety and compliance.

A DSEAR assessment, which is recommended every three to five years, will help to identify the level of risk within an organisation so that an appropriate strategy can be built to control and reduce that risk. And following changes to DSEAR in 2015, many sites handling diesel now require an assessment too. Are you meeting your obligations?

What are your duties?

According to HSE, employers must:

  • - Find out what dangerous substances are in their workplace and what the risks are
  • - Put control measures in place to either remove those risks or, where this is not possible, control them
  • - Put controls in place to reduce the effects of any incidents involving dangerous substances
  • - Prepare plans and procedures to deal with accidents, incidents and emergencies involving dangerous substances
  • - Make sure employees are properly informed about and trained to control or deal with the risks from the dangerous substances
  • - Identify and classify areas of the workplace where explosive atmospheres may occur and avoid ignition sources (from unprotected equipment, for example) in those areas
